AnthroCreate Terms of Service / General Terms and Conditions (TOS / GTC)

Last Updated: 04.Jan.2025These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and AnthroCreate ("we", "us", or "our") regarding the use of our photography and videography services, including but not limited to personal, customized, commissioned, or pre-designed content (collectively, "Services"). By engaging our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.---1. Scope of Services
1.1 AnthroCreate provides professional photography and videography services, including but not limited to:
- Personal photo and video shoots, including IRL character, cosplay, furry, and brony content.
- Digital post-production, including color correction, retouching, editing, and optional delivery of raw files.
- Commissioned or customized content created specifically for the Client.1.2 Services are provided as agreed in individual booking confirmations, proposals, or contracts. Any additional requests outside the agreed scope may incur extra fees.---2. Personalized and Custom Content
2.1 All Services involving personalized, commissioned, or custom content are final and non-refundable. By placing an order, the Client expressly acknowledges and agrees that the content is custom-made according to the Client’s specifications.2.2 Any dissatisfaction or request for changes in personalized content does not entitle the Client to a refund, unless explicitly agreed otherwise in writing.2.3 AnthroCreate reserves the right to refuse or cancel requests that violate applicable laws, infringe intellectual property rights, or are deemed inappropriate.---3. Booking and Payment Terms
3.1 Booking of Services is confirmed only upon receipt of full or agreed deposit payment.3.2 Accepted payment methods include Bank Transfer (SEPA) or Cash.3.3 Prices are listed in Euros (€) unless otherwise indicated. All taxes, including VAT, are the responsibility of the Client, unless stated.3.4 Failure to complete payment may result in cancellation of Services, delayed delivery, or additional fees.3.5 Any discounts, vouchers, or promotions are only valid as explicitly stated and cannot be combined with other offers unless agreed in writing.---4. Delivery and Digital Rights
4.1 Edited images and videos will be delivered via agreed cloud services, digital transfer, or physical media as specified in the order.4.2 Delivery times vary depending on the chosen package, complexity, and workload. While AnthroCreate strives for timely delivery, delays do not constitute a breach of contract.4.3 Upon full payment, the Client receives commercial and non-commercial usage rights for delivered content, unless otherwise stated.4.4 AnthroCreate retains the right to use any content for portfolio, marketing, social media, exhibitions, or promotional purposes, unless the Client explicitly requests otherwise in writing.4.5 All raw or unedited files remain the property of AnthroCreate unless explicitly purchased by the Client. Raw files are provided "as-is" and may require additional editing or technical adjustments.---5. Cancellation and Refund Policy
5.1 Standard Service bookings may be canceled with at least 24 hours notice for partial refunds, minus any non-recoverable costs.5.2 Personalized or custom content is strictly non-refundable, including changes in the Client’s preferences, delayed requests, or dissatisfaction after delivery.5.3 In the case of rescheduling, AnthroCreate will make reasonable efforts to accommodate new dates, but availability cannot be guaranteed.---6. Client Responsibilities
6.1 The Client must provide accurate and complete information for the Services, including character specifications, preferences, and necessary consent for all persons depicted.6.2 The Client is responsible for ensuring that all content submitted for custom work does not violate copyright, privacy, or other third-party rights.6.3 The Client agrees to cooperate with AnthroCreate to enable proper execution of Services, including attending scheduled sessions, providing requested materials, and responding promptly to communications.---7. Intellectual Property
7.1 All intellectual property rights in the delivered content remain with AnthroCreate, except for the rights explicitly granted to the Client upon full payment.7.2 The Client may not claim authorship of the content, remove AnthroCreate branding/watermarks (unless granted rights), or license it to third parties beyond the granted usage rights.7.3 Unauthorized reproduction, distribution, or commercial exploitation of content without permission constitutes copyright infringement and may result in legal action.---8. Liability and Limitation of Liability
8.1 AnthroCreate shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use, delivery, or misuse of Services or content.8.2 AnthroCreate is not responsible for:
- Loss, corruption, or technical failure of files on cloud services or client devices.
- Any injuries, accidents, or damages occurring during physical shoots (IRL sessions).8.3 Liability for direct damages caused by gross negligence or willful misconduct is limited to the total amount paid for the respective Service.8.4 Nothing in these Terms shall limit or exclude liability for death or personal injury caused by AnthroCreate’s negligence, or for any other liability that cannot legally be excluded.---9. Privacy and Data Protection
9.1 Personal data collected during booking or service delivery will be processed in accordance with our Privacy Policy, available here.9.2 The Client consents to the collection, storage, and processing of personal information necessary to provide the Services.9.3 The Client may exercise rights to access, correct, or request deletion of personal data by contacting AnthroCreate via the Contact Form.---10. Governing Law and Jurisdiction
10.1 These Terms are governed by and construed in accordance with applicable european law.10.2 Any disputes arising from these Terms or the Services may be addressed in a competent court chosen at AnthroCreate’s discretion, without limitation to any specific location.10.3 If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.---11. Amendments and Modifications
